Zoning Board of Appeals

Appointment and Organization: The Zoning Board of Appeals, often referred to as the ZBA, consists of five members appointed by the Town Board for staggered terms of five years. The Town Board also designates a Chairperson and a Secretary. The ZBA elects its own Vice Chairperson.

Powers and Duties: The Zoning Board of Appeals' jurisdiction is appellate only and is limited to hearing and deciding appeals from and/or interpretations of any written order, requirement, decision or determination made by the Zoning Enforcement Officer. These appeals may be for:

  • Area Variances
  • Use Variances
  • Interpretations

Procedure:

The ZBA meets at 7:00 PM on the second and fourth Thursday of each month excluding legal holidays. Legal notices of public hearings are published in the official newspapers of the Town one week prior the public hearing.

Decisions by the ZBA must be rendered within 63 days after the close of the public hearing. The Board usually does much better than that and, barring any unforeseen circumstances, renders its decision at it's next scheduled public meeting.
